These Terms of Service (“Terms”) govern your access to and use of the websites, online forms, booking calendars, and other digital services operated by Sheriff Sole & Madej Inc. (“SS&M,” “we,” “us,” or “our”), including sheriffsoleandmadej.com and trustee.ca (collectively, the “Services”). By using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. About SS&M

SS&M is a Licensed Insolvency Trustee firm operating under the Bankruptcy and Insolvency Act of Canada. Our trustees and professional staff are licensed and supervised by the Office of the Superintendent of Bankruptcy.

2. No Professional or Legal Advice on the Websites

The information presented on our websites and through our online tools is provided for general informational purposes only. It does not constitute legal, financial, accounting, tax, or insolvency advice, and it does not create a trustee-client or other professional relationship between you and SS&M. A professional relationship is established only after we have completed appropriate intake, conflict checks, and engagement documentation. You should not act or refrain from acting on the basis of information on our websites without consulting a qualified professional.

3. Free Consultations

We offer initial consultations at no cost and with no obligation. A free consultation does not, by itself, retain SS&M as your trustee. Any retention of SS&M is subject to a separate engagement and the legal requirements of the Bankruptcy and Insolvency Act.

4. Eligibility

You must be the age of majority in your province of residence to use the Services to request a consultation. By submitting a form, you confirm that the information you provide is accurate and that you are the individual you represent yourself to be.

5. Use of the Services

You agree to use the Services only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the Services. You agree not to:

  • Submit false, misleading, or fraudulent information.

  • Use the Services to send unsolicited communications or to harvest information.

  • Attempt to gain unauthorized access to any portion of the Services, our systems, or the personal information of others.

  • Interfere with or disrupt the Services or the servers and networks that support them.

6. Communications and Consent

By submitting a form or providing your contact information, you consent to receive communications from SS&M regarding your inquiry, including by email, SMS, and telephone. You may opt out of marketing communications at any time by following the unsubscribe instructions in our emails or by replying “STOP” to text messages. Standard message and data rates may apply to SMS communications. We will continue to send you transactional and service-related communications as necessary.

7. Intellectual Property

The Services, including all text, graphics, logos, images, software, and other content, are owned by or licensed to SS&M and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content from the Services without our prior written consent, except as permitted by law.

8. Third-Party Links and Services

The Services may contain links to third-party websites or services. We do not control and are not responsible for the content, policies, or practices of third parties. Your use of any third-party site or service is subject to that third party’s terms and privacy policy.

9. Disclaimers

The Services are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any information provided through the Services is complete, accurate, or up to date. Your reliance on any information on the Services is at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, SS&M and its partners, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Services, even if we have been advised of the possibility of such damages. Our total aggregate liability arising out of or in connection with the Services will not exceed one hundred Canadian dollars (CAD $100).

Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for fraud, gross negligence, or wilful misconduct.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to its conflict of laws principles. You agree that the courts located in Ontario will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, subject to any mandatory jurisdiction provisions that apply to your matter as a licensed insolvency engagement.

12. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date indicates the most recent revision. Your continued use of the Services after a revision constitutes your acceptance of the updated Terms.
